Partner Visa – Australia
A Partner Visa (subclasses 801 and 820) allows an Australian citizen, as well as the permanent resident or an eligible citizen of New Zealand to bring their spouse or partner to live with them in Australia.
They are going to grant a Temporary Partner Visa ( subclass 820) to them first so that they can come and live in Australia. While they are living here, the government is going to process the permanent partner visa (subclass 801).
You must be in a de facto relationship or married to:
- A citizen of Australia
- Permanent Residency holder in Australia
- An eligible citizen of New Zealand
- Australian law should recognise your marriage. People who are of age 16 or 17 should have parental permission

Partner Provisional (Subclass 309/100)
Australian Citizen or permanent resident holder, as well as an eligible citizen of New Zealand, can use the subclass 309 visa to bring their de facto partner or the spouse to live with them in Australia. The applicant of the visa should stay outside Australia when this application is submitted.
Prospective Marriage (Subclass 300)
A person should use the subclass 300 to get the visa that is necessary to come and marry a prospective spouse that is from Australia. Since it is a temporary visa, it is valid only for nine months. The person who is applying for this visa should be outside Australia until it is approved.
Partner Permanent/ Temporary
Using the subclass 820 or 821, an Australian citizen or permanent resident holder, or an eligible New Zealand citizen can bring their de facto partner or spouse to come and live with them in Australia. The person should be in the country when they apply for this visa.
Key Requirements
The only way an applicant will qualify for the visa is when they can prove to the concerned authority that they are married or are in a relationship with the citizen or permanent resident holder of Australia or an eligible citizen of New Zealand. People in a same-sex relationship can also apply for the visa.
